Privacy policy

Information on how the Schloss Thun Foundation processes your personal data.

Valid from 1 January 2019 until revoked.

1. General

This privacy policy explains how the Schloss Thun Foundation (“Stiftung Schloss Thun”, hereinafter “we”) handles personal data (“your data”). We attach great importance to protecting the personal rights of the users of our products, comply with the applicable data protection provisions, and take the necessary measures to protect your data. Third-party websites accessible via our own websites are not subject to these data protection rules; we accept no responsibility or liability for them.

2. Data processing and purposes of use

2.1 General

“Personal data” means any information relating to an identified or identifiable person (for example name, telephone number, address, e-mail address, as well as data from registration, booking, competitions or surveys). “Processing” means any handling of personal data (collection, storage, administration, use, transmission, disclosure, deletion). Your data is used only for the purposes stated in this policy. We protect it against loss, theft and misuse. Your data may be exchanged with service providers of the Schloss Thun Foundation and used by them for the purposes mentioned here.

2.2 Non-anonymous users

Upon registration, booking/order, newsletter sign-up or competition entry, we collect personal data (first/last name, address, e-mail, where applicable payment details, telephone numbers, date of birth, voluntary profile data); enrichment with data acquired from third parties is possible. Use: performing the contractual relationship, enabling/verifying the booking, personalised display of the user account, handling contact enquiries, sending newsletters, notifying/publishing winners; evaluating usage behaviour to improve our services; customer relationship management, marketing, tailored advertising. Transmission between browser and our servers is encrypted (HTTPS); users are required to use a current version of a common browser.

2.3 Anonymous users

When you visit our website, we and third parties collect data via cookies and similar technologies (text files stored on the user’s system to analyse usage; recognition of returning visitors; individualised services). Cookies improve our services, making them more effective and more secure. Storage can be prevented in the browser settings (“do not accept cookies”), which may limit functionality. Usage is measured by technical systems, predominantly from third-party providers (anonymously or on a personal basis), in particular to analyse browsing behaviour and measure reach; also used for marketing, improving our offering, target-group-appropriate formats and needs-based design (for example pop-ups).

3. Disclosure to third parties

No disclosure, unless required by law or ordered by a court. Excepted is disclosure a) for the legal protection of users, b) to comply with legal requirements, c) to defend and protect our rights, d) to ensure compliance with the terms of use or data protection provisions, e) to resolve technical difficulties, f) to service partners for order/contract processing (limited to the data required), g) to service partners for marketing, analysis of technical data, processing/storage. We work with a limited number of carefully selected partners with high data protection and security standards; disclosure only to the extent necessary. In the event of a reorganisation of the Foundation’s assets, personal data may be transferred as part of the transaction.

4. Transfer abroad

Where necessary and appropriate, we also transfer personal data to third parties abroad.

5. Third-party plug-ins and integrations

Our offerings are networked with third-party functions (for example social network plug-ins such as Facebook, LinkedIn, Google, Twitter; visits to our presence on third-party sites). If you have an account with these third parties, they may measure your usage; in doing so, your IP address, browser settings and other parameters may be transmitted and stored. We have no control over this and accept no responsibility for it.

6. Legal basis

Processing is always carried out in accordance with the applicable data protection provisions. Bases: contractual relationship (including pre-contractual measures), legal obligations, overriding interest (needs-based development of our offering, marketing, appealing presentation of relevant services – an important basis for financing and further development; our interests are aligned with those of users; objection possible under sections 8 and 9), and consent, where obtained.

7. Retention period

For as long as necessary for the purpose or as long as another legal basis exists; in the case of contractual relationships, at least for their duration as well as for the ongoing limitation periods or statutory/contractual retention obligations.

8.1 Access and rectification

Free-of-charge access, rectification/completion of data.

8.2 Deletion and restriction

Please note: statutory or contractual retention obligations may preclude deletion; in that case the data will be restricted/blocked instead; partial deletion may limit the use of our services.

8.3 Right to object

8.4 Data portability

Where applicable.

8.5 Withdrawal of consent

With effect for the future; the usual use of our services may no longer be possible thereafter.

8.6 Complaint

To the competent supervisory authority (place of residence, workplace, or place of the alleged infringement).

9. Objection

9.1 Anonymous users

Retargeting can be prevented via the browser setting “do not accept cookies”; further processing is governed by the instructions in section 2.3.

9.2 Registered/logged-in users

No targeting → e-mail to info@schlossthun.ch with the note “No targeting as a logged-in user”.

9.3 Marketing measures

9.4 Newsletter

Unsubscribe via the link in the newsletter.
